New York’s 2026 estate-tax basic exclusion is $7,350,000. Estates just above that figure face a brutal cliff: once the taxable estate exceeds $7,717,500 (105% of the exclusion), the entire exemption disappears and every dollar is taxed. Irrevocable trusts — including Spousal Lifetime Access Trusts (SLATs) and Grantor Retained Annuity Trusts (GRATs) — can move appreciating assets out of the taxable estate while still benefiting family members.

Special Needs Trusts: Never Losing a Benefit

A child or sibling with a disability often depends on Medicaid or SSI. A direct inheritance disqualifies them from those benefits. A properly drafted SNT under EPTL § 7-1.12 holds assets for that family member’s supplemental needs — education, travel, technology, quality of life — without touching their eligibility.
